United Therapeutics settles Liquidia patent fight; Liquidia to pay $330.4 million and drop Yutrepia PH-ILD label
United Therapeutics has settled its legal fight with Liquidia Technologies, with Liquidia agreeing to pay $330.4 million and stop selling its inhaled drug Yutrepia for a lung-disease indication, United Therapeutics said Wednesday in a regulatory filing.
The settlement, signed Oct. 13, resolves patent cases in Delaware and North Carolina plus trade-secret claims in North Carolina state court. It follows a Sept. 30 ruling in which the Delaware court held Liquidia liable for infringing United Therapeutics’ ’327 patent, which covers inhaled treprostinil for pulmonary hypertension associated with interstitial lung disease, or PH-ILD, and runs to Feb. 3, 2042.
Liquidia will pay $185 million within 30 business days as an estimate of damages on past Yutrepia sales for PH-ILD. It will pay another $145.4 million, in two $72.7 million installments due by Feb. 1 and April 30, 2027, for continuing PH-ILD sales after the agreement.
The deal also changes Yutrepia’s label. Liquidia agreed to immediately ask the FDA to remove the PH-ILD indication from Yutrepia’s labeling and to stop marketing the drug for PH-ILD right away. Once the FDA approves that change, Liquidia must stop selling Yutrepia bearing the PH-ILD indication, and going forward it may promote the drug only to practitioners who treat pulmonary arterial hypertension. Liquidia must also end the PH-ILD cohorts of its ASCENT trial.
In a separate piece of the deal, United Therapeutics will pay Liquidia $10 million to settle the RareGen and Sandoz litigation over generic Remodulin. A federal appeals court on Oct. 7 had vacated a $61.6 million damages award against United Therapeutics in that case and sent parts of it back for further proceedings.
United Therapeutics said it may continue to pursue trade-secret claims against former Liquidia executive Robert Roscigno.
